If you are a featured recording artist or a sound recording copyright owner (SRCO), producer or creative contributor, you may have earned digital performance royalties for the use of sound recordings you own or on which you performed. Artists and SRCOs should register with SoundExchange as soon as possible, even if you’re a member of another performance rights organization, as only SoundExchange can provide digital royalties. Registration is fast and always free. Copyright holders and featured artists (generally, the most visible person, in print or image, on the physical package of a recording) are paid through SoundExchange.   The Digital Performance Royalties Fund (DPR) was established to collect and distribute monies to non-featured musicians and non-featured vocalists pursuant to the DPRA (Digital Performance Rights Amendment) and DMCA (Digital Millennium Copyright Act). These acts require the allocation of 5% of compulsory license fees to non-featured performers, 2 1/2 % to non-featured musicians, and 2 1/2% to non-featured vocalists collected from various digital distributions of sound recordings. The first payments to the DPR were for the non-featured performers a share of the compulsory license fees collected from February, 1996 through March, 2000 from the cable and satellite subscription services. In addition to the ongoing payments from these sources, future revenue from the statutory rates collected for web-casting will be added to these payments.

Performance Rights and Digital Royalties Heat Up in Congress

Two bills are gathering attention on Capitol Hill and in the press surrounding “performance royalties,” the payments radio companies make to artists and music creators in exchange for broadcasting their songs.
Internet radio proponents are pushing the “Fair Internet Radio Royalties Act of 2012” draft legislation sponsored by Rep. Jason Chaffetz (R-UT). The bill claims to erase differences in the calculation of payments from various digital music services to performers and music creators. To do so, the legislation would reduce royalty rates for Internet radio stations to the so-called 801(b) standard, which is currently being used by only a handful of companies such as satellite radio services and certain cable music services that were grandfathered into this lower standard. In reality, the bill could drastically slash digital performance royalties to artists, labels and everyone else in the creative community participating in the digital performance revenue stream.
This bill also fails to address the most important disparity between music services: AM/FM
broadcasters enjoy a unique and decades-old exemption from paying any performance royalties
to recording artists and record labels. AM/FM radio makes billions in advertising revenue every
year without paying a single penny to the musicians that created the songs they play. By
ignoring this special loophole for broadcast radio, the bill lets stand one of the greatest
inequities in the music industry today.
Ray Hair, international president, American Federation of Musicians (and a SoundExchange
board member), warned in a recent op-ed that the bill “could set us back decades…[i]nstead of
ensuring that terrestrial radio stations pay musicians fairly…it would allow the digital platforms
to pay musicians less too, at rates far below market value.”
Fortunately, this attempt to drastically change the music landscape has prompted a response:
the draft “Interim Fairness in Radio Starting Today Act of 2012,” from Rep. Jerrold Nadler (DNY). This proposed legislation recognizes the need for real equality in the calculation of payments by Internet music services without slashing payments to music creators by adopting
the “willing buyer/willing seller” standard (currently used for Internet radio rates) for all digital
platforms including Internet radio, satellite radio and cable music services. The bill also takes a
step toward addressing terrestrial radio’s unfair exemption.
Under existing law, different types of services operating under the statutory license (that
SoundExchange administers) have their royalty rates set by different rules. Internet radio
companies like Pandora, and most of the more than 1,800 services that pay SoundExchange, pay
based on a “willing buyer, willing seller” standard. This standard directs the Copyright Royalty
Board (CRB) to set royalty rates representing the fair market value for the recordings that they
use (i.e. what a “willing buyer/willing seller” would negotiate if there were no statutory license).
These Internet radio, satellite and cable TV services are built upon the content from this creative
community, and it’s only fair that they pay what music creators could get in the marketplace.
Ironically, satellite radio behemoth SiriusXM does not have its rates set by the “willing
buyer/willing seller” standard. Instead, because of a special interest legislative loophole,
SiriusXM’s rates are set at a below market rate by the CRB. As a result, SiriusXM rates were
slashed between 25 percent and 50 percent in the last CRB proceeding.
Since that proceeding, Sirius and XM merged and now, according to Q2 2012 financial results,
the combined company projects $3.4 billion in revenues, and free cash flow of approximately
$700 million this year. While SiriusXM maintains a cheerful outlook, it was the creative
community that subsidized SiriusXM’s growth.
Now Pandora wants to pay less, too, even as it has thrived under the current standard,
celebrating a successful IPO and achieving explosive growth. The company beat its financial
guidance the past two consecutive quarters, and with its Q2 FY 2013 earnings report, raised its
full-year revenue forecast to $425 million to $432 million. Pandora has also increased its market
share, with listener hours up 80 percent year-over-year.
SoundExchange agrees with Pandora Founder Tim Westergren, who recently testified to
Congress that “it is time…to level the playing field and to approach radio royalties in a
technology neutral manner.” However, SoundExchange believes that all digital radio services
should compensate artists and creators at a market rate. The organization also believes that the
real injustice is the fact that terrestrial radio pays nothing at all.
Nadler’s proposed “Interim Fairness in Radio Starting Today Act of 2012” could begin to address
these issues. In contrast, the so-called Internet Radio Fairness Act could be a step backward for
the creative community.

R&B Sensation LaWanda Lee, Makin Noise ..... Midwest Stand Up !

It wouldnt be right to have a blog for the Indie artist and not put one peice of my music on the site ! So while I'm compiling a list to feature and present to you , I present to you ME ! LaWanda Lee started singing at the age of 5 years old with her father Lee Osler from Ypsilanti Mi., .LaWanda's first time in the studio was at the age of 6 , she recorded a song called "One God, One World" with her father and several other children of different nationalities. LaWanda then went and got into the childrens chior at Messiahs Temple Apostolic, Church,in Ypsilanti , and from there is where she knew she could harmonize and sing leads and hold my own that was about the age of 8. LaWanda then moved to Inkster Michigan a small city about 15 minutes from Detroit, and met some friends at Inkster High School, and joined a group called "Modesty", & had a cd out under an independant record label called Ibdoina records entitled , C'mone .With Modesty , she went on a three city tour, and performed with arists such as , Toney Thompsom ,and A Few Good Men. They also opened up at the State Theater for comedians , Tony Little ,and Adelle Givens. They also open up for RBL posse at the Cosmos in Inkster Michigan . Unfortunately the group didn't last .LaWanda Lee now have the pleasure of working with producer /engineer /musician, Anthony Booker , from Detroit , Mich . We have officially finished my first Debut Album , entited "First Born"  .This Album contains collaborations with local artists, Jun Goddie , and Deon from the group "7 mile". the creation of a new name, term, symbol, design, or combination thereof for an established brand with the intention of developing a differentiated (new) position in the mind of stakeholders and competitors.Far from just a change of visual identity, rebranding should be part of an overall brand strategy for a product or service.This may involve radical changes to the brand's logo, brand name e.g.orphan initialism, image, marketing strategy, and advertising themes. These changes are typically aimed at the repositioning of the brand/company, sometimes in an attempt to distance itself from certain negative connotations of the previous branding, or to move the brand upmarket. However, the main reason for a re-brand is to communicate a new message for a company, something that has evolved, or the new board of directors wish to communicate.Rebranding can be applied to new products, mature products, or even products still in development. Welcome to my blog , and thank you for taking to the time to check out my site! My first post is called " Bring the Noise " in reference to musicians and artists across the world. I am an indie artist/songwriter/entertainer, and boy do I know how hard it is to try and get your music to the ears of potential fans for as cheap as you possibly can especially without little to no backing. In this post I will promote a few artists , Dj's, musicians, poets, and a large scale of other professionals doin it independent! Notice I said Professional. After all you are after you start to get paid for your craft.
I will also post different articles that are benefitial for the artist that is trying to finally " get there". We all need a little help sometimes , and I'm taking the time to give you that little extra push up that ladder. feel free to post and promote, and network. I ONLY HAVE ONE RULE. WE are struggling artists in this dirty and complicated industry. NOONE WORKS FOR FREE! so if youre looking to collaborate with an artist you see posted here, be prepared to pay their fee. First up is Model/Singer/Actress Maria Katre' Osler. She is definitly a woman who knows what she wants and not afraid to go out there and get it !
 
Bio
 
 
Maria Katre Osler ‘aka’ (Maria Katre) was born and raised in Ypsilanti, Michigan which is part of the Metro-Detroit area. She comes from a very musical family. She was introduced to a wide variety of music at age 4, and from then on it was easy for her to memorize beats, rhythms, lyrics, songs, harmonies and the artists that sang and wrote them. Her grandmother noticed that she had a gift and she would soon catch others attention. She would often hear she possessed an “Old Soul” with the way she carried herself and her selection of music. In elementary school, her music teachers noticed she had an unique ear for music at such a young age. She loved anything that Motown, Jazz, Gospel, and Loved R&B & Classic R&B. One song that she recalls grabbing her attention first was “Soulful Strut,” by (Young Holt Unlimited). Every time her mother would listen to this on the oldies radio station, she would dance and make up her own lyrics because it is an instrumental piece. At the age of 8, her third grade teacher noticed that she stood out again from the rest of her class, not only with her musical ear but with acting. She was approached by her teacher to be a lead in a school play because she was very independent for someone her age. Not knowing her gifts at the time, she knew she loved music and playing a game she called (TV Shows) with her friends. In that game they would act out their favorite shows from television. These hidden talents became her strengths through the years. Katre received two full ride musical scholarship offers for playing the (Tuba) but turned them down to tryout other interests. After attending various colleges including Florida State University and lastly she attended Florida A&M University. In December 2008, she graduated with a B.S degree in Broadcast/Journalism and Minor in Theatre. During her last semester in the school of Journalism, she wrote, produced, and directed her first documentary entitled ,”In Their Eyes.” This documentary followed the lives of a blind adult and a blind child and how they live their daily lives.
For a long time Maria Katre, found it fascinating that those who are blind were able to do the same things individuals with sight were able to do, but were viewed incapable because of their disabilities. Her goal was to show everyone that just because one has a disability doesn’t mean that they aren’t capable. Ironically, her musically niche became obvious in her documentary with the selection of songs in several scenes. She was paired up with an amazing videographer/editor and her message was successful! In the summer of 2009, her professor submitted her documentary for competition with the University of Florida and she and her documentary partner won a 1st place Associated Press Award for her documentary.Some TV/Film that Maria Katre’s has worked on several productions including: Scrubs,  90210, Hawthorne, Harry’s Law, My Brother’s Keeper (webseries), The Talk (CBS), and lastly, a HollaBack (a horror film). Maria Katre currently resides in Los Angeles and is currently working on her music while studying piano. She also has been a print model who has done various of lifestyle print-ad shoots.
